Three cheers for Raynsford
Article Abstract:
The Housing Grants, Construction and Regeneration Act 1996, which came into effect on May 1, 1998, appears to have been extremely successful. This legislation, widely known as the Construction Act, was guided through its final stages in parliament by Construction Minister Nick Raynsford. He must therefore take a large part of the credit for its success. There were some concerns about the potential impact of the Construction Act, but these have proved unfounded. Improvements to this legislation would include giving adjudicators the power to amend their decisions in exceptional cases.

Article Abstract:
There is still considerable confusion within the UK construction industry about the matters an architect, or an arbitrator, exercising his review powers, should take into consideration in deciding whether a contractor is entitled to an extension of time under clause 25 of the JCT conditions. Under clause 25.3.1, the architect is entitled to grant a reasonable extension of time if he or she believes that a delaying event notified by the contractor is a relevant event. However, this is hard to establish in practice.

Breaking the speed limits
Article Abstract:
There were some concerns statutory adjudication for the UK construction industry would not be enforced in a court of law. A case heard in the UK courts helps to establish the legality of statutory adjudication for the construction industry. Any person choosing to use the court to try challenge adjudication could be faced with legal costs of both sides. Statutory adjudication was introduced as part of the Scheme for Construction Contracts.
