Market share and market power in merger and monopolization cases
Article Abstract:
Federal courts would benefit from the to use economists when deliberating on antitrust cases in light of the increasingly sophisticated tools of industrial organization economics and the growing reliance on the federal courts to settle competitive matters. The benefits provided by the approach are significant enough to outweigh its costs. It is claimed that the legal requirement for courts to make conclusions about the market power based on market shares can be misleading.

Germany is the chief exporter of industrial equipment to China and Southeast Asia. Germany's export earnings in Asia made up almost 10% of worldwide business of the country; its overall commodity/merchandise trade with Asia was fairly balanced, coming to $41 bil for either side for 1996 according to the International Monetary Fund. Bauma (Munich) is the largest display facility for sale of construction machinery.

Merger analysis in the courts
Article Abstract:
Court decisions on mergers between 1982 and 1992 showed higher winning percentages for private and state plaintiffs. An examination of the decision-making process of the federal courts revealed that political affiliation of the relevant court, identity of the plaintiff, economic merits and evidence on barrier to entry and other competitive factors determined the outcome of the case.
