Look before you sign

Nomination paperwork under Amendment 10 of JCT 80 is less than before but considerable signing is still required, calling for sub-contractors to be very careful with the small print. Contract documents consist of the articles of agreement, drawings, specifications or bills of quantities and contract conditions, the articles of agreement identifying the two sides in the sub-contract and briefly stating their obligations under the sub-contract. The 'Standard Form of Articles of Nominated Sub-Contract Agreement between a Contractor and a Nominated Sub-Contractor' consists of seven separate pages and there is much that should be carefully studied before signing.

Turn of main contractor

Amendment 10 of The Standard Form of Building Contract, JCT80, covers 'Particular Conditions' including negotiations between main- and sub-contractor. It is these two who enter into contract to carry out building work, so both of them need to have an active and full say in timetables for the work and other contract-related factors. Time scales for approving architects' drawings, facilities for laying down insurance coverage, adjudication nomination and paying arrangements for Value Added Tax are also laid down.

The road to nomination
Article Abstract:
Nominating enables the electrical contractor to enter into an agreement with the employer rather than being a subcontractor having an agreement with the employer's main contractor. There are 'Standard Forms of Nomination Instruction' for this purpose. The advantage is that it can enable the smaller company to be paid direct by the client, it often being necessary for the small contractor such as an electrical contractor to do a great deal of work on a site even before the main contraactor is known.
