Parties behaving unreasonably
Article Abstract:
When seeking appeal costs, it is often difficult in planning disputes for claimants to prove that the other party has acted unreasonably. Two cases in which appeal costs were awarded because of unreasonable action by one of the parties are examined. The cases illustrate the complexity of such appeals and focus on the need for inquiry timetables to be met and also that full evidence supporting the grounds of the refusal must be submitted.

Testing the waters: appeals update
Article Abstract:
The boundaries of many local authorities often contain substantial areas of water and the use of such areas is generally controlled by national guidance or by relevant local plan policies. Two different proposals for such areas are discussed. The first involved construction of a club house and land and water use changes on a site in the green belt. The other was for a 40 berth marina.

It should be ensured that affordable housing remains affordable according to a speaker at the TCPSS. Planners must make sense out of a combination of legal uncertainty and policy confusion in affordable housing matters. It was questioned whether the provision of a particular type of accommodation would be affected by the grant or refusal of permission.
