The role of apology in mediation
Article Abstract:
Apology can play an important role in mediation, and thus should not be dismissed or idealized. Apologies can be tactical, explanatory, formalistic, or 'happy-ending,' the latter being a sign of true remorse that can transform the concerned parties' relationship. Factors that influence the effectiveness of apology include aspects of character such as self-image, interpersonal orientation, and gender; the role played by lawyers and the legal system; timing, manner and the intervention of the mediator; the length of the conflict; and the nature of the dispute and availability of other forms of relief.
