A new era of unapproved drugs: The case of Abigail alliance v Von Eschenbach
Article Abstract:
The US Court of Appeals for the District of Columbia has claimed in the case of Abigail Alliance for Better Access to Developmental Drugs v Von Eschenbach that terminally ill patients can have a constitutional right to purchase unapproved drugs that have successfully completed phase 1 testing. The ruling in May 2006 might help patients in using the latest new untested treatment, but has threatened the ability of the US Food and Drug Administration (FDA) to protect public health.

The Supreme Court and Bedside Rationing

The impact of the US Supreme Court's unanimous decision in Pegram v Herdrich, 2000, is discussed. The Justices claimed that health care rationing was national policy in the US and said federal law permits giving doctors financial incentives to limit care.
