Abortion issue clouds nomination
Article Abstract:
The controversial social issue of abortion has undermined the ease of physician Henry W. Foster Jr.'s confirmation to the office of US Surgeon General. Foster's nomination ran into trouble when, two days after the Feb 2, 1995, announcement, Foster admitted that he had performed 'fewer than a dozen' abortions during his 30-year career as a physician. The Clinton administration had reported that Foster had performed only one abortion. The American Medical Assn continues to support Foster's nomination, citing his capabilities as a physician and educator.

Expert witness sued for giving his opinion during peer review
Article Abstract:
Internist Eric Voth is facing a $30 million malpractice suit for his expert testimony in the 1988 Kansas State Board of Healing Arts' peer review of Arthur P. Taliaferro, who was suspected of improperly prescribing drugs. The board dropped disciplinary action against him, settling instead for his promise to maintain better records. Since this was not a court case, witnesses were not immune to prosecution. However, this is the first case of an expert witness being sued for malpractice based on testimony.

Dr. Foster faces hearings dominated by politics, abortion
Article Abstract:
The Senate Committee on Labor and Human Resources will open hearings May 2, 1995, on the appointment of Henry W. Foster, Jr., M.D. as Surgeon General. An obstetrician and gynecologist, Foster is administrator of Meharry Medical School, Nashville, TN. Republicans anxious to score points against Pres Clinton are expected to oppose the nomination. Abortion opponents will probably cite Foster's opinion that abortion should be 'safe, legal and rare.'
