The new Mental Capacity Bill plans to introduce laws that guarantee people a legal right to withdraw a living will, which expresses what exactly patients want from the medical care. Amongst other advance decisions in the bill, it would also introduce a new criminal offense of ill treatment or neglect of a person who lacks capacity that would carry a custodial sentence of up to five years.
