Method patent fails; court: surgeon doesn't have to pay royalties

A US District Court has decided that Jack A. Singer, MD, did not infringe on the surgery method patent owned by Samuel Pallin, MD. Pallin developed a sutureless incision method used in cataract surgery, but the court has decided that some parts of the patent are invalid. The American Medical Assn is against patenting any surgical or medical method because any such procedures or medical information should be free and available to all. The US patent office will focus on making patents more enforceable in courts.

Information technology is the top priority of health care providers, according to an Andersen Consulting survey. Healthcare industry spending on automated information systems, which increased 13% from 1993 to 1994, is expected to increase 53% by 1997. In Sep 1995 the Dept of Commerce awarded 10 grants to providers and vendors working on innovative information technologies. The largest grant, $21 million, is being used to create medical knowledge banks for community-based practitioners.
