West Virginia is planning to ask residents eligible for Medicaid due to low income, to sign documents listing 'member responsibilities and rights' including adherence to medication and physicians' appointments. The practical difficulties in following the agreement are discussed, suggesting that physicians must take on the responsibility of speaking out and explaining how these policies affect their practices and their patients' health.

The concept of surplus lines insurance in comparison with the state licensed insurance is detailed. It is proposed that if the surplus lines insurer goes out of business, there is no guaranty fund to cover losses, however, experts advice physicians to protect themselves by thoroughly researching potential carriers.
