Burden of proof: why Bailey should be preferred to Nelson
Article Abstract:
With reference to burden of proof and the provisions contained in Section 63A of the Sex Discrimination Act, 1975, the merits in Court of Appeal's decision in Bailey and others v. the Home Office are highlighted. The reasons for preferring the said decision to the Court of Appeal's decision in Nelson v. Carillion Services Ltd. are also furnished.
