Article Abstract:
Prof. Cass R. Sunstein's academic argument that cost-benefit analysis, even a qualitative cost-benefit analysis, should be applied to all regulatory rulemaking was made without political consensus and by ignoring political realities. A survey of health and environmental regulation exemplified how the cost-benefit analysis was one portion of a complex, value laden assessment process. Those who supported arguments such as Sunstein would not be the ones willing to share risk information and would turn the analysis against the overall public welfare.

Impact of the environmental justice movement on American industry and local government
Article Abstract:
The notion of environmental justice has reached the courts and state and federal regulatory bodies, suggesting that claims of environmental racism will be taken seriously and should be considered by those involved in the hazardous wastes and environmental industries. The major factors in determining environmental racism are the demographic aspects of the workforce or area involved, affects on populations not included in the census track and the involved company's decision making processes.
