Now spotlight is on states in tobacco war; seeking to recover Medicaid monies paid for sick smokers, AGs have taken center stage
Article Abstract:
State lawsuits against tobacco companies gained more prominence when a 5th US Circuit Court of Appeals panel refused to certify Castano v American Tobacco as a class action. Some eight states have filed lawsuits against the tobacco industry and more than 20 others are reputedly interested, all making fraud and addiction allegations as Castano did, as well as other claims based on state laws. Both sides seem prepared for a stiff fight, and neither is likely to back down before one or two cases are tried.
