AIDS drugs raise issue of recoupment for R&D; drug companies sued to stop South Africa's proposed measures to avoid high costs
Article Abstract:
A discussion of the successful effort by major drug companies to strike down the South Africa law providing for compulsory licenses and parallel importation of affordable AIDS drugs as an unjust abridgement of the patent rights covering the use of such drugs is given. A system using territoriality for purposes of exclusivity and exhaustion of the patent holders' rights might work best.

The article considers the patentability of gene sequences, an issue because protein molecules are important to many disease states. Whether expressed sequence tags (ESTs) are patentable is one issue, and patent applications for these will probably have to be supported by the full-length sequence.
