Aguilar: a mistake in statutes?
Article Abstract:
The US Supreme Court recently heard arguments on the government's request that it overturn a 9th Circuit Court Court of Appeals decision that upset the conviction of US District Court Judge Robert P. Aguilar. The issue in question is the interpretation of federal laws regarding disclosure of wiretaps, and of making false statements to FBI agents. Justice David H. Souter seemed skeptical of the government's arguments, and Justice Stephen Breyer expressed discomfort with the scope of both statutes, 18 USC 1512 and 18 USC 1503.

Court asks why VMI must stay stag
Article Abstract:
The US Supreme Court seemed ambivalent on Jan 17, 1996, when it heard arguments in United States v. Virginia and Virginia v. United States, over the Virginia Military Institute's exclusion of women. The justices seemed unwilling to give gender the same protections as race under the Constitution but also reluctant to preserve the college's present system. Gibson, Dunn & Crutcher lawyer Theodore B. Olson argued on behalf of the school and its adversative method, while Deputy Solicitor General Paul Bender spoke against it.

Corporate giants lock horns over granting of vacatur
Article Abstract:
The US Supreme Court will, in Izumi Seimisu Kogyo Kabushiki Kaisha v. US Philips Corp, speak on the practice of vacatur as a way of resolving a high-stakes suit. In this practice, parties settling their case at the appellate level request the higher court to set aside a lower court judgment. Proponents of the practice maintain it encourages court economy and lawsuit settlements, while opponents charge it markets judicial decisions to the highest bidder.
