America needs balanced reform in business law
Article Abstract:
The proposed federal products liability law is a balanced document taking into consideration the views of both the legal and business communities. Since the late 1970s, interstate commerce has become more important and now over 70% of the goods manufactured in one state are shipped to another. As a result, states no longer have control of their products liability laws. The proposed law would cut down on unnecessary legal costs by encouraging parties to settle cases early in the process. It would also augment incentives for accident prevention and extend the statute of limitations.

Haslip may alter tort-claim strategies
Article Abstract:
The Supreme Court's decision in Pacific Mutual Life Insurance Co. v. Haslip has been influential, leading to the overturning or remanding of 12 cases in less than a year. The court held that the large punitive award in Haslip did not violate the due process clause of the 14th Amendment. The court did imply, however, that there are constitutional limits on punitive damages, but left the definition of these limits to the states. Several state courts have since revised punitive damages procedures in light of Haslip.

Article Abstract:
Torts are still listed in the law school curriculum, but what is taught under that name is no longer the subject older lawyers value. Today's law students cannot evaluate major change without knowing the reasons for the current system. Alternative ways of addressing torts are important, but students are not ready for them without understanding the past.
