Article Abstract:
Issues are discussed regarding US Court of Appeals for the Federal Circuit rulings that even a monopolist may exclude others from its intellectual property, either in the context of refusing to sell or to license a product that embodies that intellectual property. The rulings were Intergraph Corp. v. Intel Corp., in 1999, and In re Independent Service Organization Antitrust Litigation, in 2000.

In ruling on antitrust, does Fed. Circuit overstep? Its exertion of jurisdiction over nonpatent issues puts district courts in bind over precedents
Article Abstract:
The application of newly created antitrust law to the plaintiff's antitrust claims in the Federal Circuit's ruling in CSU v. Xerox is discussed. CSU charged Xerox with unlawful refusal to sell or license the copyrighted software or manuals it made to service Xerox-brand equipment. Controversy regarding whether the Federal Circuit should hear a case involving antitrust law is discussed.

Article Abstract:
The article discusses the US Supreme Court's May 1999 ruling in California Dental Ass'n v. FTC, an antitrust case which also has key importance for joint ventures and strategic alliances. The case also has implications for non-antitrust cases involving expert evidence.
