As the judges see it, they are unwilling participants in a futile and unjust system
Article Abstract:
Federal judges are unhappy with the US Sentencing Commission's mandatory guidelines which they feel deprive them of judicial discretion and force them to overpunish drug offenders without helping the war against drugs. There is evidence that judicial discretion has given way to prosecutorial discretion and abuse of the guidelines. The House Subcommittee on Crime and Criminal Justice and the Senate Judiciary Committee should hold public hearings on the effect of the sentencing guidelines in the federal courts.

Sex discrimination in the membership regulations of private clubs continues to be a subject of litigation and of bills under consideration in state legislatures. Some cities and states have followed New York City's example, passing laws reclassifying certain private clubs as public accommodations.
