Attorneys' fees in class actions governed by fee-shifting statutes
Article Abstract:
The author examines statutory attorneys' fees shifting provisions and the common fund doctrine in class actions. The problems that arise when the two methods combine in hybrid class actions are discussed and possible solutions to the settlement incentive problem are proposed.
