Bias cases strike at treaty shielding foreign business: the 5th Circuit rebuffs effort to pierce immunity from bias suits that Japanese-owned U.S. businesses enjoy

Treaties of Friendship, Commerce and Navigation between the US and Japan, Korea, Greece, and Spain allow companies incorporated overseas to evade some US anti-discrimination laws in hiring and promoting their own nationals. The US Supreme Court and several circuit courts have ruled on challenges to these protections, generally in favor of the employer. Some questions remain over whether US-incorporated subsidiaries, as well as direct branches, are covered, and precisely what sorts of jobs are protected.

A discovery by DuPont: hidden costs of winning; the Teflon maker has won summary judgement in 47 jaw implant suits - and learned it's too risky to be a supplier
Article Abstract:
DuPont has won 47 straight summary judgments in suits over jaw implants and it has learned the risks and potential costs of being a medical supplier on any scale. It sold medical manufacturer Vitek about 5 cents worth of Teflon for each implant, and has now spent some $40 million on a thousand lawsuits claiming the implant went bad. DuPont Senior Counsel Ross Schmucki says it is a classic case of lawyers seeking the deepest pockets in sight. DuPont has lost and appealed one case.
