E-litigation; what's in a Net name?
Article Abstract:
The exponential growth in litigation involving Internet domain names is discussed. The necessary elements for a claim under the Anti-Cybersquatting Consumer Protection Act are discussed. Trademark infringement rulings involving the use of another company's name as a metatag are also discussed.

Two World Intellectual Property Organization rulings indicating that not all uses of a registered domain name qualify as acts of cybersquatting are discussed. They are Deutsche Welle v. DiamondWare Ltd. and Goldline International, Inc. v. Gold Line.

'Brookfield' sets standards on domain name rights; 9th Circuit made key rulings on intent to use doctrine and use of another's mark in metatags
Article Abstract:
The United States Court of Appeals for the 9th Circuit's ruling in Brookfield Communications, Inc. v. West Coast Entertainment Corp. makes clear that the use of another's trademarks in metatags is improper and that second-level domain names carry an independent-source meaning and should be analyzed as trademarks separate from first-level domain endings such as .com. The decision also makes clear the 9th Circuit's view that registering a domain name with an intent to use it in commerce is not a commercial use under the Lanham Act.
