Jailed spy escapes in circuits' split over wire fraud
Article Abstract:
The Ninth Circuit has split with the Second Circuit and thrown out German exporter Werner J. Bruchhausen's conviction for wire fraud. The court held that American companies did not have the property rights needed for a fraud prosecution since they were paid in full for their products even though Bruchhausen was not truthful about their final destination. The Justice Department may try to get the US Supreme Court to intervene.

The new media suits; recent actions focus on what reporters do, not what they say
Article Abstract:
Many rulings of the late 1990s focus on how the First Amendment interacts with torts of general application, or whether it makes a difference if a tort such as trespass or documents theft was committed in an effort to gather news. Sanders v. American Broadcasting Co. and Shulman v. Group W, Inc., are examples, and the California courts who ruled on these cases established zones of privacy not connected to speech zones but defined by intrusive acts and illegal conduct.
