For religion, speech cases, a landmark era: First Amendment law in a state of flux
Article Abstract:
First Amendment issues were addressed often and with vigor by the Supreme Court during its 1992-93 term. Doctrinal control over issues such as freedom of speech, freedom of religion and the establishment clause is destined to be altered by the court's decisions. The court has moved towards less government control over religion, and has moved away from endorsing any one religious belief at the expense of others. Court cases pertaining to First Amendment rights are discussed.

In two cases, court OKs speech limits; the 'Forbes' and 'NEA' decisions approve greater governmental control over forms of speech
Article Abstract:
Arkansas Educational Television v. Forbes and National Endowment of the Arts v. Finley, decided during the Supreme Court's 1997-98 term, show a trend toward allowing greater government control over protected speech. In the former, Ralph Forbes, a candidate for public office in Arkansas, argued that excluding him from a televised pre-election debate because he had no chance of winning the election violated the First Amendment, and the court held his exclusion reasonable under the circumstances. In Finley, several performance artists challenged the congressional amendments to NEA funding legislation.
