Communication and strategies in the mediation of disputes
Article Abstract:
Mediation, in which a third party acts as mediator to promote settlement talks between disputants, has supplanted binding arbitration as the prevailing form of conflict resolution. The mediator's role is thus crucial, and he or she must carefully consider alternative strategies and methods. In particular, he or she must take into account the substantive, procedural, and emotional/psychological needs of the parties.
