Article Abstract:
Rulings handed down in 1999 create new conditions for downward departures from the federal sentencing guidelines. These include such departures when the defendant willingly stipulates to an uncontested deportation after release from prison, post-sentencing efforts toward rehabilitation and extraordinary rehabilitative efforts.

The jury selection rulings handed down by courts in 2000 are discussed, and show the challenge to courts of preventing bias in jury selection procedures while still allowing the use of peremptory challenges.While the Supreme Court has been considering how peremptory challenges relate to challenges for cause, lower courts have been focusing on the scope of the court's limits on using peremptory challenges.

Appellate judges must spend much time keeping up with the changes in sentencing laws as sentencing cases make up more than 50% of their work load. Judicial discretion in departing from these guidelines may be permissible with claims of diminished capacity, dedication to charitable works, and rehabilitation. Departures are used to decrease extreme strictness in the guidelines, and tailor sentences for both defendant and crime.
