'Atwater' poses issues
Article Abstract:
Atwater v. City of Lago Vista, a search-and-seizure ruling which was even covered in the popular press, is criticized because of its questionable grounds for condoning jailing a mother for a traffic violation. The majority opinion went back to British and colonial law approving custodial arrests for nonjailable crimes.

Criminal rulings primarily benefit the prosecution; court upholds Kansas' Sexually Violent Predator Act as well as broader automobile searches
Article Abstract:
The US Supreme Court's main criminal law decisions during 1996-97 generally favored prosecutors and the police. The court upheld Kansas law on sexually violent predators, which appeared likely to lead to similar laws in other states. Automobile searches was another area in which the court upheld broader powers for police officers. The admissibility of prior conviction evidence and the knock-and-announce rules were the focus of two other major criminal cases during the term.
