Death penalty system in turmoil; report says indigent defense underfunded in Texas, making situation "desperate."
Article Abstract:
A report on counsel for capital defendants in Texas issued in Mar 1993 condemns the state's system of providing representation for death penalty defendants. Texas is one of the few states which do not fund legal representation for indigent capital defendants. Some court-appointed counsel are provided through county-funded systems, but these provisions vary and are frequently inadequate. Habeas corpus proceedings rely almost entirely on an inadequate supply of volunteer lawyers. The report recommends a system of state funding of lawyers for capital defendants.

Death's advocate; defense lawyer seeks execution - at her client's request
Article Abstract:
Murderer Douglas Alan Smith wants capital punishment rather than the prosecution-recommended life sentence, and his attorney Jamie McAlister, feeling the decision is rational and legal and that the defense lawyer is duty-bound to respect the client's wishes, is trying to be a vigorous advocate for this decision. His lawyer's advocating for a death sentence not even wanted by the prosecution is unprecedented.
