Detroit Newspaper strike: NLRB chairman's opinion authorizing the General Counsel to seek a section 10(j) injunction
Article Abstract:
The National Labor Relations Act Section 10(j) allows for temporary relief in cases where there is ample evidence of unfair labor practices as in the case against The Detroit Newspapers. Over 100 charges were brought in the case between the newspapers and the unions with Administrative Law Judge Thomas R. Wilks finding evidence to support some of the charges. The authority to seek injunctive relief in federal court under 10(j) was given because delay in reinstating employees would result in them seeking other jobs, making eventual relief ineffective.

Article Abstract:
A report by the chairman of the National Labor Relations Board has gone well during his tenure, with considerable progress made on various reforms, though some resistance has appeared. His fundamental goal remains enforcement of the existing law and support for stare decisis. The federal court system has accorded the Board great deference and recognizes its credibility, upholding Board decisions more than 80% of the time on average. Also discussed are increased use of 10(j) injunctions, new administrative law judge procedures, and more.

There can still be productivity and economic competitiveness when government regulators intervene in the labor market. Such Clinton administration measures as the anti-deficit initiative of 1993, the Family and Medical Leave Act, minimum wage legislation and Clinton's commitment to the National Labor Relations Board's enforcement prove that the opposite is the case.
