Ex parte gets harder to pin down
Article Abstract:
Attorneys and the US Department of Justice (DOJ) have debated the application of the ex parte rule to governmental investigations in the criminal and regulatory areas. Government lawyers' special problems can be covered by an exception to ABA Rule of Professional Conduct 4.2 allowing ex parte contact when it is 'authorized by law.' The legal profession has doubts about special DOJ rules on the subject.

Whose is the privilege?
Article Abstract:
Attorneys claim the attorney-client privilege too often, sometimes doing so when there is nothing to be gained. Claiming the privilege can look like attorney and client are covering something up and not claiming it can cause the jury to see parties as open and frank. The privilege may keep out of the trial very probative evidence and attorneys should avoid claiming it automatically.
