Ethics on hold; new legislation reining in federal lawyers confuses rather than clarifies
Article Abstract:
Legislation subjecting federal government attorneys to the same state ethics guidelines that apply to other attorneys is to be enacted on Oct 21, 1999. There may be enough detail in this law by the time it is enacted to sort out the conflicting laws and rulings. The 1989 Thornburgh memo stated that Justice Department lawyers could contact parties they knew to have counsels' representation, , but ABA Model Rule of Professional Conduct 4.2 prohibits contact with another attorney's client unless authorized by the other lawyer or the law.

Article Abstract:
The article describes the Y2k scenarios which various lawyers imagine, the results of the Y2K suits already filed, and the legislation considered to limit Y2K liability. About 30 states have considered laws to limit Y2K liability, and Pres Clinton signed a bill limiting punitive damages in Y2K suits. By June 1999, fewer than 100 Y2K suits had been filed, and most of the future litigation will be between businesses and concern supply or productivity disruption.

The increase in Web sites serving the legal profession, especially to pairing lawyers with clients, and the need of these sites for ethical advice from lawyers are discussed. Online lawyering is the way of the future, especially for small firms and solo practitioners. Some of the ethical questions are detailed.
