Financial services not easy 'marks;' it's getting tougher to come up with distinctive names
Article Abstract:
Selecting a new service mark in the financial services industry can be difficult since the industry is conservative. Marks new enough that they are not likely to be confused with those already in use can be hard to find. Since service marks are new to the intellectual property family, the law concerning them has been adapted from trademark law. Litigation has concerned mainly house marks rather than product marks.

Article Abstract:
The Glass-Steagall Act's move to a functional regulation of financial services activities is discussed. This means that the kind of activity will determine who supervises it. In keeping with the functional theme, bank securities activities will be under SEC supervision.
