The goal of a Markman hearing is to persuade the judge to define the scope of a patent in a way that will make it easier for counsel to prove the infringement or validity issues at trial, and smart use of graphic evidence can help with this task. The guidelines for counsel to follow when developing a visual strategy are a framework around which specific evidence can be organized easily, reinforcing key themes with simple and appealing graphics, and specific techniques to increase attention and retention.
