Gun sale, owner liability grows
Article Abstract:
Six recent cases have raised the hopes of gun control proponents that gun sellers and owners can be found liable for injuries or death from the misuse of guns after purchase. However, opponents of gun control argue that the cases do not indicate a trend toward increased liability. The cases include 'Farley v. Snugg Enterprises' that led to a $100,000 verdict against a Virginia Beach, VA gun shop that allowed the straw sale of a pistol whose real buyer, a high school student, later killed a teacher with it.

Rodriguez v Mallory Capacitor Co relates to an exceptionally high rate of birth defects in the Texas-Mexico border community of Harlingen and allegations that these are due to Mallory's moving raw materials, including chemicals of unknown origin, between Matamoros and Harlingen. Mallory no longer exists and in addition to proving a link between the chemicals and the birth defects, the plaintiffs will also have to address the liability of successor corporations.
