Just deserts; suits against nursing homes, alleging neglect, are up and producing some very big verdicts

The increase in suits against nursing homes are discussed, and linking understaffing to corporate profit motives is key, as many are owned by large, for-profit corporations. Obtaining medical records on the patient's injuries and examining them for a pattern of understaffing and neglect should also happen.

A National Law Journal survey of 100 jury awards of $1 mil or more from 1997 that were reviewed by trial and appellate courts is discussed. The study finds that federal and state courts are accepting verdicts that would have been slashed or rejected as excessive just a few years ago.

Large verdicts for sale; plaintiffs sell portions of million-dollar judgments to weather long appeals
Article Abstract:
Judgment Purchase Corp (JPC) is the most prominent among the growing number of companies who buy and sell interests in prospective judgments. Selling to such companies can be a way for plaintiffs to get through long appeals. A panel of appellate lawyers advises JPC after investigating a case whether the corporation should invest. The three criteria used are whether there is a prejudicial error which might serve as a reason for overturning the judgment, the quality of briefing and of the plaintiff's claim.
