Hazy fee-shifting rule paves way for litigation
Article Abstract:
The Copyright Act permits the award of attorney fees paid by the loser, an unusual element in US law, but the lack of clear guidelines breeds rather than reduces litigation. In Fogerty v. Fantasy Inc., the US Supreme Court rejected an argument that attorney fees should be awarded automatically, and said plaintiffs and defendants should be treated alike in this regard. Without a bright line, courts are left with few indications of when such an award is justified. Many use a 12-factor evaluation to determine the size of an award.

Borton, Petrini & Conron annually hosts the Bakersfield Business Conference, one of the largest and perhaps the best conference of its kind in the world. Firm managing general partner George Martin oversees the event, which in 1994 had 12,500 paying guests at $315 each, and used a 148,000-sq-ft tent. The conference typically breaks even financially, helping to promote the firm rather than boost its profits. The Oct 1995 shindig, long sold out, features George Bush, Gerald Ford, Dan Quayle, Margaret Thatcher, and more.

From school to firm: where hiring partners found their incoming class of associates
Article Abstract:
The law schools that supplied new associates for large law firms in 1995 are listed. The firms are listed alphabetically, followed by the total number of associates hired, the names of the schools and the number of students from each, if more than one. The list indicates that firms do not necessarily draw from schools in their immediate area. About 120 firms are included in the listing.
