Article Abstract:
The effect of the Telecommunications Act of 1996 on changing the preexisting regulatory agenda by injecting the free market approach to the telecommunications industry, while requiring local carriers to continue to provide a degree of universal service, is discussed. Issues relating to the deregulatory environment are also discussed.

U.S. West, Inc. v. FCC: exposing the deficiencies in government attempts to protect customer privacy
Article Abstract:
A 10th Circuit ruling in US West v. FCC that the agency's customer proprietary network information (CPNI) regulations infringed upon the plaintiff's right of free speech and constituted a regulatory taking is discussed. The ruling interpreted section 222 of the Telecommunications Act of 1996.

Article Abstract:
The very large increase in the competition for local services since passage of the Telecommunications Act of 1996, and the risk that the ongoing implementation of the Act's unbundling and pricing provisions will actually undermine efficient facilities-based competition are discussed.
