Stockholders' holding claim class actions under state law after the Uniform Standards Act of 1998
Article Abstract:
The author discusses securities fraud claims under state and federal law prior to the Private Securities Litigation Reform Act of 1995 and how the PSLRA and the Uniform Standards Act of 1998 changed the balance of power between the federal government and the states. The deterrent and compensatory effects of preemption of holding claim class actions are analyzed.

Reconciling the juridical links doctrine with the Federal Rules of Civil Procedure and Article III
Article Abstract:
The author analyzes the relationship between the concerted action exemption to the juridical links doctrine and Supreme Court decisions on standing and class actions. The uncertainty over whether the doctrine is an exception to the Federal Rules of Civil Procedure or Article III of the Constitution is discussed.
