The liberal reputation of the United States Court of Appeals for the 9th Circuit is discussed. One section is devoted to litigators standing out in 9th Circuit cases.

P&G peddles a private patent court
Article Abstract:
Procter and Gamble's in-house counsel has developed a private forum for trying patent disputes meaning these disputes cost less time and money. The court would resolve infringement disputes for $100,000 to $250,000 before these fights become much more expensive. The federal court system's delays have created the need for a new forum, and guidance to a business early in the product development process so that a possible infringement could be modified or licensed would also help.

Arbitration is no simple matter; many fret that it is morphing into (gasp!) litigation
Article Abstract:
The Uniform Arbitration Act, which has been adopted in some form by most states, is undergoing revision for the first time in four decades, and critics charge that the revisions make arbitration more like a trip to court, while others claim that preventing conflicts of interest and other illegalities makes the process more fair. The issue reopened since the latest public draft is whether arbitration awards should be appealable.
