At-will employees and the Civil Rights Act of 1871: an expansion of remedies
Article Abstract:
The legal rights of 'at-will' employees have gained ground in recent years as the result of the enactment of employment discrimination laws and judicially-created decisions. In its 1998 Haddle v. Garrison decision, the Supreme Court extended the concept of employee protection to include as a cause of action the intimidation of or retaliation against witnesses in federal court proceedings. The decision was in line with the law's increased emphasis on fairness in employment decisions.
