Mandatory arbitration and labor not ideal mix; high court to examine whether ADR clauses are enforceable in most employment contracts
Article Abstract:
Issues are discussed regarding the enforceability of ADR clauses in most employment contracts. Employers have increased their use of mandatory arbitration provisions in employment contracts and judicial and legislative developments have confused the issue rather than provided clear guidelines. Case law is discussed.

Fear of harm cases on the rise; most state courts have rejected these claims lacking objective evidence of the feared disease

The increase in litigation regarding the fear of future damage to health caused by exposure to potentially harmful substances is discussed. Exceptions to the still applicable general rule that fear damages are not recoverable are summarized.
