Court revisits issue of punitives; chance to set standards?
Article Abstract:
The US Supreme Court will again rule on punitive damages in TXO Production Corp v Alliance Resources, Inc. In 1991, the Court ruled in Pacific Mutual Life Insurance Co v Haslip that some state court punitive damages procedures might constitute due process violations. TXO, found guilty at trial, argues the need for a formula connecting punitive with compensatory damages, while the attorney defending the original verdict thinks they should be tied to the anticipated gain from the illegal conduct.
