Market power in franchise cases in the wake of Kodak: applying post-contract hold-up analysis to vertical relationships
Article Abstract:
Court decisions that measure franchisor market power at the pre-contract phase are discussed. Also discussed are post-contract hold-ups where buyers are locked in to suppliers due to switching costs, use of upcharges by franchisors on required inputs, and application of post-contract market analysis to the Kodak decision and subsequent cases.
