Novel Michigan fee plan struck
Article Abstract:
The Michigan Supreme Court, in Recorder's Court Bar Assn v. Wayne County Circuit Court, struck down the county's system of paying court-appointed counsel for indigent defendants and gave the county until Dec 1, 1993 to come up with another system. Fees under the old system were set according to the maximum sentence for the most serious crime charged. The court ruled the system overpays attorneys whose clients plead guilty rather than go to trial and underpays those who encourage clients to take full advantage of their rights.

Contingent fee arrangements get ABA nod; the bar group ducks the larger public policy debate
Article Abstract:
The ABA's Standing Committee on Ethics and Professional Responsibility has rejected the conservative Manhattan Institute's proposal to declare contingency fees unethical in some cases, ruling that such fee arrangements are ethical if the fee is reasonable and the client has been told of alternative billing options. The committee did not feel its mandate included ruling on public policy issues not directly related to ABA rules.
