Article Abstract:
Issues are discussed regarding the difficulty of proving lost electronic commerce profits. Electronic commerce patentees should thus consider a reasonable royalty to be the probable outcome of a patent infringmement lawsuit. Lost profits may only be a realistic objective when a patentee has successfully marketed a product implementing the patented invention.

The increase in questionable Internet patents and the added controversy over business method patents in general are discussed. The Business Method Patent Improvement Act of 2000, pending as HR 5364, is discussed and has been received coolly by most of the patent bar. The EU views on the issue are also discussed.

In re Spalding Sports Worldwide, Inc, the Federal Circuit opinion on the inclusion of information about an invention submitted by an inventor to a patent attorney is covered by the attorney-client privilege is discussed. Reasons the court concluded that such information is privileged are discussed.
