Privilege at risk due to Whitewater; near-absolute client right hangs in balance on appeal
Article Abstract:
Special Prosecutor Kenneth Starr's investigation of Hillary Clinton's role in the 1993 firing of White House travel office employees was the impetus for the Swidler & Berlin v. United States claim, and Starr's grand jury subpoenaed the notes a Swidler partner took during an interview in which Vince Foster, shortly before his suicide, sought the attorney's counsel. The US Court of Appeals for the District of Columbia Circuit ruled that the attorney-client privilege and work-product doctrine do not shield notes when the client is dead and the information is sought in a criminal proceeding.

Ethics adviser gets raise: Whitewater counsel Ken Starr relies heavily on Watergate veteran Sam Dash

Georgetown University Law Center Professor Samuel Dash works extensively to provide Whitewater Independent Counsel Kenneth W. Starr with ethics advice. The workload resulted in a raise in July 1995 from $1600 per week to $3200, reflecting an assumed workload increase from four to eight hours per week. Critics of the situation say Dash's work and rate are reasonable, but that the total sums involved are high because of Starr's extensive private legal work, raising further questions about his appointment.
