Protection of data under HIPAA is still volatile issue; rules proposed under Health Insurance Portability and Accountability Act trouble both privacy advocates and the industry

Issues are discussed regarding the potential impact on individual privacy of the simplification of health insurance administration contemplated by the Health Insurance Portability and Accountability Act (HIPAA) and the need for added privacy protection. The use of the electronic media to exchange and store medical information contemplated by the law, the HIPAA privacy rule, and the law's administrative simplification provisions are all discussed.

Issues are discussed regarding third-party beneficiary actions or suits under state laws which may provide ways to enforce violations of the privacy rule the Department of Health and Human Services promulgated under the Health Insurance Portability and Accountability Act, since that department did not afford a private right of action to enforce violations of the rule.
