School danger zones: courts reject efforts to hold schools liable to student shooting victims
Article Abstract:
Several courts have addressed the issue of public school liability for student shootings that occur on school grounds and all have denied liability. One case denied 42 U.S.C.A. 1983 damages because the school must have created a situation in which the shooting death occurred rather than just not preventing one. Another ruling denied a due process violation because, though students are required to attend, they are not in custody of the state. The third held that the school did not have the student in direct control and was not aware of the dangerous situation.

Courts breathe life into efforts to reduce cigarette use
Article Abstract:
Several federal and state courts have authored rulings favorable to the antismoking movement and many local and state legislators have introduced bills to limit smoking despite the antiregulatory attitude of the Republican-controlled Congress. Key rulings include a Second Circuit decision that requiring a smoking ban in McDonald's and Burger King was a reasonable accommodation under the Americans with Disabilities Act and that smokers cannot reasonably expect their habits to be private and therefore job application questions do not violate privacy.
