Sears reps practiced law illegally; but using real lawyers in credit card debt sessions might be too expensive
Article Abstract:
US Bankruptcy Judge Samuel L. Bufford ruled on Feb 26, 1998, that Sears, Roebuck and Co lawyers were guilty of the unauthorized practice of law for sending a non-lawyer "account representative" to negotiate a reaffirmation agreement with a couple not represented by counsel. The judge will consider sanctioning the law firm, Leibowitz and Constantino, which has worked with Sears on reaffirmation agreements since 1991. This case was the latest one in which bankruptcy judges throughout the country have investigated Sear's aggressive pursuit of agreements reaffirming credit card debts of bankrupty debtors.

Texaco: a culture full of hubris; analysis of full tapes shows a contempt for discovery
Article Abstract:
Texaco Inc has showed a contempt for the process of discovery in its unwillingness to release fully tapes useful as evidence in the race discrimination lawsuit filed against the company. Richard A. Lundwall, a Texaco executive dismissed during a corporate downsizing, secretly made the tapes. Texaco has released some tape excerpts as explanation for the executives' racial slurs, but declined to release the whole tapes. The National Law Journal obtained access to a copy of the tapes and on them senior Texaco executives show contempt for the judicial process.

SEC is beefing up regional offices with new recruits
Article Abstract:
The Securities and Exchange Commission (SEC) is increasing its staff in its regional offices to bolster its enforcement efforts. The SEC's 13% 1992 staff increase will be concentrated mostly in New York, NY; Los Angeles, CA; and Chicago, IL. SEC Chairman Richard C. Breeden is pushing for better regulation of investment advisers and broker-dealers.
