State Clean Air Act programs undefined
Article Abstract:
There is much confusion about how states are to implement the final EPA regulations on the Clean Air Act Amendments of 1990, even though it has been a year since they were published on Jul 21, 1992. Several environmental groups, six states and most key trade associations have submitted appeals on the rules. States are to file their permit program regulations with the EPA for review and approval by Nov 15, 1993. The regulations affect both states, which must adopt permit regulations that accord with federal law, and companies which want as much operating flexibility as possible built into permit applications.

Sparks fly over Clean Air Act permits
Article Abstract:
The EPA has issued a proposed rule implementing the Clean Air Act Amendments of 1990 establishing minimum standards for any program to be managed by an air pollution control agency. Subsection 70.7(f), dealing with minor permit amendments (MPA) has generated the most controversy, with the regulated community approving and environmentalists calling it a travesty of justice. MPAs are more streamlined since they do not require public notice and require only seven days notice to the permitting authority and administrator, after which they become effective unless one of these has objected.

EPA clarifies lender liability standards
Article Abstract:
The EPA issued a statement on Apr 29, 1992 clarifying which persons CERCLA's lender liability rule may apply to. CERCLA's liability provisions are contained in Section 101 and 107 of the act and apply to four classes, including the 'owners or operators' of a facility. The lender liability problem pertains to the definitions of the terms 'owner or operator,' 'security interest' and 'contractual relationship' as used in the act.
