Superstores are major FTC target; new antitrust theory says they're a distinct submarket
Article Abstract:
The FTC asserts that traditional definitions of market share lose their relevance when investigating the retailing power of superstores. The government used this rationale in rejecting a proposed merger of the superstores Staples Inc. and Office Depot, arguing that these two and Office Max comprised a unique competitive space and that the merger of two of these would raise consumer prices. The FTC argues that superstores compete only with each other, not with independent stores or other office suppliers.

Who will pay for discarding of files in Sunbeam case?
Article Abstract:
Paul B. Kazarian's wrongful termination suit against the Sunbeam Oster Co has evolved into a dispute over whose fault it is that documents were discarded which had been inventoried for probable lawsuits about his termination. New York's Skadden, Arps, Slate, Meagher and Flom represents entities which control most of Sunbeam stock and has requested a declaratory judgment on the validity of Kazarian's dismissal from the company from the court. Kazarian's lawyers want the suit against him dismissed.

Securities lawyers go east - to China for stock offerings
Article Abstract:
Foreign investors' interest in China has increased as that country's economy has been growing at a healthy rate, and US securities attorneys have been courting business from Chinese enterprises who need help with the legal aspects of raising capital from these investors. US lawyers may not get this business if Chinese companies choose to register their securities on exchanges in Hong Kong or mainland China rather than the US stock exchange.
